The bench of Alliance for Progress (App) presented a bill which would modify article 91 of the Constitution and the Organic Law of Elections to make it impossible to apply for Congress of former officials who have had access to secret, reserved or confidential information in the last five years.
The initiative, promoted by the congressman Alejandro Soto and backed by other members of its bench, establishes an exception for parliamentarians who integrate investigating commissions or the Intelligence Commission.
However, Miguel Pérez ArroyoColonel’s lawyer Harvey Colchadohe warns that the measure would directly affect his represented, who in his work in the Division of Investigation of High Complexity Crimes (Diviac) has managed information classified in investigations on corruption and organized crime.
In conversation with Peru21, Pérez Arroyo said that the bill “is absolutely discriminatory” and that “is not related to the democratic principle of citizen participation that is guaranteed in the Constitution.”
“In that sense, even no prosecutor, no other state official, even those who are in the Intelligence Commission, the admirals of the Navy, or even the police themselves could not have postulated,” added the lawyer .
In addition, the lawyer recalled that Juan José Santiváñez would have made clear his intention to apply to the position of deputy or that of Senator and emphasized that, if the bill was approved, the head of the Ministry of Interior could not apply either.
“It is not a bill that is related to the democratic principles that guarantees the Constitution in relation to citizen participation in the political activity of the State,” concluded Pérez Arroyo.
The project has been sent to the Constitution Commission for its debate and, if approved, would require constitutional reform, which implies overcoming several legislative barriers.
Background of the case
Colonel PNP Harvey Colchado was passed to the retirement for “cadres renewal.” The former head of the Division of Investigation of Crimes of High Complexity (Diviac), ceased to be active on January 1, 2025.

The Commission is made up of the PNP General Commander, Víctor Zanabria; Lieutenant General PNP, Óscar Arriola; the PNP general, Luis Gamarra; and the general PNP Zenón Loayza, Juan José Serrano and Jorge Villacorta.
