INE: Senate has until the end of the month to comply with parity in judicial election

They ask for parity in the Judiciary

The majority of the rules were approved unanimously, since the objective is that the distribution of women and men elected for each circuit and electoral judicial district is joint Total vacancies of each specialty within the judicial district, so that there are as many men as women, in the entire judicial circuit.

It was determined that in any circuit or judicial district, more men can be elected than women, “beyond a difference of one, considering the none numbers.”

But if more women are elected than men, “there may be a distance of more than one, in compliance with the principle of flexible parity.”

As approved, to assign positions of ministers and ministers of the Supreme Court of Justice of the Nation (SCJN), the Magistrates of the Superior Chamber of the Electoral Court of the Judicial Power of the Federation (TEPJF), as well as the members of the people of the Court of Judicial Discipline (TDJ), which are chosen nationwide, there will be two lists, one of women and another of men.

These will be ordered according to the number of votes obtained in descending order.

The number of charges that corresponds to the most voted women and men will be assigned alternately, starting by women, to integrate all vacant spaces.

In the case of the five regional rooms of the TEPJF, the same will proceed but by multinominal constituency.

For the allocation of circuit magistrates charges and district courts in judicial circuits where there are two or more electoral judicial districts there will also be two lists, one of women and the other of men, separated by specialty in each electoral judicial district and these will be ordered according to number of votes obtained in descendant order.

The assignment will be “ziper” type, that is, alternately between the most voted women and men, and will always begin by wife.

In the case of judicial districts with a single vacancy of a certain specialty, “the man or woman can be initially assigned with the largest number of votes obtained”, unless there are a greater number of men currently in the charges.

In the case of circuit magistrates and district courts in judicial circuits whose geographical framework is formed by a single electoral judicial district, in which there are also a couple of positions and two specialties with a single vacancy, there will also be two lists and They will be assigned alternately starting with a woman.

However, the difference will be that if there is only one vacancy in the specialty, the winner or the winner will be assigned indistinctly, unless there are more men in the judicial district, in which the space will touch a judge, the most voted .

“In this way, the distribution of women and men elected for each circuit and electoral judicial district must be joint in its horizontal and vertical aspect, both of the total number of specialties of each district, and of the total of vacancies of each specialty within the judicial district, so that in the entire judicial circuit gender parity is guaranteed ”.

It was also determined that in any circuit or judicial district, “more men can be elected than women, beyond a difference of one, considering the none numbers, however, in the case that more women are elected than men, they may There is a distance of more than one, in compliance with the principle of flexible parity. ”
