Amnesty for crimes against democracy is unconstitutional, say jurists

The Federal Supreme Court (STF) sentenced to 17 years in prison the man who stole a replica of the 1988 Constitution during the scammer acts of January 8, 2023. Marcelo Fernandes Lima has been arrested since 2023 and was denounced by the Attorney General’s Office (PGR) for crimes of armed criminal association, qualified damage, deterioration of the overturned heritage, violent abolition of the Democratic Rule of Law and attempted coup.

In addition to serving the sentence in closed initial regime, the accused will have to pay $ 30 million in solidarity with others convicted by 8 January for the damage caused.

The copy of the Constitution was at the entrance of the STF plenary, a place most affected by the depredation during the coup acts, and was returned by the accused.

During the criminal case, Marcelo Fernandes’ defense denied that he used violence or serious threat.
