The Prosecutor’s Office, through the area of illicit enrichment and constitutional complaints, filed a constitutional complaint against Luis Carlos Arce Córdovain his action as Superior Judge, Supreme Prosecutor and Member of the Plenary of the National Jury of Elections, for the alleged crime of illicit enrichment, to the State.
The facts would have been carried out between 2009 and 2019when the aforementioned magistrate would have abused his status as a high official, increased substantially and illegally his assets in an amount ascending to S/1,394,302,20. Also, considering the additional documentary information obtained in the investigation, This amount could ascend to S/2,464,224.44.
The background
On January 17, 2020, the then prosecutor of the Nation, Zoraida Ávalos, initiated an investigation against Luis Arce Córdova for alleged illicit enrichment. The investigation focused on the acquisition of seven properties and five vehicles since 1994, when Arce Córdova served as a criminal judge of Lima and superior judge of Ucayali. Five of the properties were acquired in 2017, and although one of them was bought by mortgage credit, it was canceled in a year. In addition, between 2002 and 2007, he registered the purchase of four vehicles. The investigation also involved his brothers, Wilder Moisés and Nelton Javier Arce Córdova.
On April 28, 2021, an official expert concluded that, when comparing the income and expenses of Luis Arce Córdova between January 1, 2009 and December 31, 2019, there was an unjustified patrimonial increase of 1,394,302,20 Soles, especially between 2013 and 2019.
However, on May 7, 2021, the expert of Jeri Ramón, current rector of the National University of San Marcos, said that the income received by Arce Córdova justified their expenses, establishing a surplus of 140,962.95 soles.
Finally, in March 2024, Supreme Prosecutor Alcides Chinchay formulated accusation against Luis Arce Córdova and his brothers for illicit enrichment. For Luis and Nelton Arce, he requested a penalty of six years and eight months in prison for each one, while for Wilder Arce he requested 13 years in prison.
