He Constitutional Court (TC) declared inadmissible the jurisdiction claim presented by the government of Dina Boluarte against the Judiciary and the Public Ministry.
In said lawsuit, the Executive sought to question the ongoing judicial processes against presidents in the exercise of their functions. However, the TC rejected the claim due to a technical error made by the Executive Branch’s lawyers.
In accordance with current regulations, any demand presented by the Presidency of the Republic must have prior approval from the Council of Ministers.
In this case, the TC observed that, although the president designated the president of the Council of Ministers to file a claim of unconstitutionality, express authorization was not granted by the head of the Executive to file a jurisdictional claim.
The Constitutional Court has given the government a period of five days to correct this error. If the deadline expires without the observation being corrected, the claim will be permanently archived.
