Congressmen with investigations against them, signed as co-authors various bills that represent a setback for the judicial systemin terms of the fight against delinquency and the criminal organizationsand that limit the work of the press in controversial cases.
Camouflaged gag
The Law 32182 takes into account legislative proposal 8507 by Popular Renewal congressman Alejandro Muñante.
This norm considers as very serious offenses and grounds for malfeasance when a prosecutor orders the release of people detained by the National Police of Peru (PNP) who have committed crimes whose sentence exceeds five years.
It also considers it a very serious offense to provide confidential information that is part of the investigation. This is how those who leak documents to the press about the investigations against senior officials of this Government and the Legislature are punished.
Among the parliamentarians who signed that initiative are Miguel Ciccia and Cheryl Trigozoboth from Renovación Popular, and Jorge Zeballosof Honor and Democracy.
Zeballos is investigated for alleged embezzlement because he is accused of having traveled to Trujillo with public resources supposedly to participate in the birthday of his colleague from Renovación Popular Diego Bazan.
Trigozo is being investigated for alleged embezzlement after a journalistic report that revealed that she had used her office worker Leifer Carrión as the manager of the group Sonido 2000, where the legislator is a vocalist.
An investigation was opened against Ciccia for alleged influence peddling due to alleged meetings at Sunat in favor of a family business. The Republic He attempted to approach the congressman about the status of this case, but there was no response at the time of writing this note.
Empower the PNP
The Law 32130which reduces the powers of the Public Ministry to entrust the National Police of Peru (PNP) the preliminary investigation of crimes, was promoted by the fujimorism.
The main author of one of the projects that promoted this law is the orange congressman Fernando Rospigliosi and among the co-authors are the legislators of Renovación Popular, Patricia Chirinos, Diego Bazán and Jessica Córdova; from Avanza País, Rosselli Amuruz; and from Fuerza Popular, Rosangella Barbarán and Martha Moyano.
Chirinos is being investigated for alleged embezzlement because she allegedly used public resources to travel to participate in the birthday party of her colleague Bazán, in Trujillo, and for her alleged links with former National Prosecutor Patricia Benavides.

His colleague Barbarán has an investigation against him for alleged embezzlement because he bought tickets with public resources to supposedly go to the Bazán entertainment.
Bazán is wanted for alleged embezzlement because his colleagues traveled with public resources to his birthday meeting in Trujillo.
Moyano is also investigated in the case of former prosecutor Patricia Benavides.
Amuruz is being investigated for alleged incompatible negotiations because Congress hired people linked to her partner, former congressman Paul García.

Córdova is being investigated for alleged embezzlement for allegedly having used the services of parliamentary coordinator Shirley Martínez Paredes to perform advisory functions in the company LOT International, which belongs to her boyfriend.
Impunity and prescription
Fujimorism also promoted Law 32107 for the prescription of crimes against humanity committed before 2002. The author of the initiative was Rospigliosi. Among the co-authors of this proposal are Ciccia, Zeballos and Barbarán.
Another counter-reform is Law 31751, which reduces the suspension of the statute of limitations for crimes to one year.
One of the legislative proposals that gave rise to this norm was presented by the congressman of Peru Libre Flavio Cruz. His initiative has as co-authors his bench colleagues Waldemar Cerrón and Kelly Portalatino and Jorge Flores, and José Arriola, from Podemos Perú.

Cerrón is investigated for alleged obstruction of justice, Portalatino for alleged personal cover-up.
Flores and Arriola are investigated for alleged salary cuts.
The Public Ministry considered that Law 31751 prevents the prosecution of serious crimes.
However, Peru Libre did not sit idly by. Congressman Cruz presented another project to force judges to apply it. And the signatories of their initiative were Cerrón, Portalatino and María Agüero. The latter is investigated for alleged salary cuts to its workers.
Cerronismo also promoted a legislative project that gave rise to Law 32108, which redefines organized crime. The main author of the initiative was Cerrón. The proposal was signed by Portalatino and Agüero.

Convenient delay
The rule that has generated the most controversy this week is the one that limits preliminary detention. Criminals can only be caught in flagrante delicto.
In December, Congress corrected the error and passed a new law. However, the Government of Dina Boluarte delayed its promulgation and observed it before the last day of the deadline.
Now this law must be debated again. The problem is that Congress is on recess and there is no desire to call an extraordinary plenary session until March.
Counter-reform of the vice president of the JNJ
Congress also approved the law that reduces the period of effective collaboration processes. This is an initiative presented by former Podemos Peru congresswoman María Teresa Cabrera, current vice president of the National Board of Justice (JNJ). Parliament took this project as a reference and gave it the green light. The Public Ministry questioned the rule.
Last December, the National Prosecutor, Delia Espinoza, presented two unconstitutionality lawsuits before the Constitutional Court (TC) against the law that delegates to the PNP the direction of preliminary investigations and the statute of limitations for crimes against humanity. Both regulations interfere with the work of the Public Ministry.
