Santo Domingo. – After the sentence of the Constitutional Court (TC) that allows the independent candidacieshe general coordinator of Citizen Participation (PC), Erick Hernández Machadoexpressed that the decision is “extremely interesting” and establishes clear conditions for future electoral processes.
Hernández Machado explained that, due to the dissident votes and the motivations, the TC considers that articles 156 and 157 of the Electoral Law limit the right to elect and be elected.
He pointed out that the next thing is to call for the regulation of independent candidacies and grant regulatory powers to the Central Electoral Board (JCE).

“The ideal is that the JCE be given regulatory power to complement what is necessary for the electoral processes,” he stated, recalling that the ruling is binding on all powers of the State.
He added that there must be equal conditions for the candidacies and also requested the supervision of the parties’ private funds.
The TC imposed requirements such as the expression of the candidate’s will, the collection of signatures from 2% of the electoral roll and the presentation of a government program, applicable to presidential, congressional and municipal candidacies.
During his participation in “Reviews, the Podcast”, Hernández Machado highlighted that independent candidacies face organizational challenges, as they do not receive public funds, which implies an extra effort for their development.
About the corruption casesindicated that Citizen Participation closely follows grand corruption cases, which face problems of stagnation, and mentioned that four out of five processes are close to being extinguished due to delays.
As for the prison systemadvocated the creation of a Ministry of Justice to improve efficiency in criminal jurisdiction and reduce judicial delays, in addition to strengthening institutions related to the registration of titles and real estate conflicts.
