The protection was presented by several plaintiffs, including Cristian Mauricio Tami Duarte, Álvaro Rueda, Sergio Flechas, Miguel Ángel Moreno, Ronald Picón, Ferley Sierra, Román López and Carlos Barajas, who alleged that the measure violated fundamental rights.
Despite the arguments presented, The judge determined that the guardianship action was not appropriate, pointing out that the implementation of public policies, such as the peak and plate, is an exclusive responsibility of the municipality and its traffic authorities.

The observer, Sergio Toledo, pointed out that Some vehicles are abusing the privilege of registering outside of Santander.
“We welcome this measure that restricts vehicles registered in other directions of traffic. Because now It is very easy to change the registration of the city vehicle to city. We do not understand how high-end trucks, for example, are involved in scandals and do not pay taxes in the city. Taxes that all the rest of us must assume so that they circulate in the metropolitan area,” Toledo said.
In this sense, the judge clarified that It is not up to constitutional justice to intervene in the definition of these policies, which are the responsibility of the territorial entities.
