Court sentences mother of Colonel Núñez de Aza to 5 years of suspended prison for money laundering

Santo Domingo. – The Third Collegiate Court of the National District sentenced Rosa Antonia Disla, mother of Colonel Rafael Núñez de Aza, to five years of suspended prison after being found guilty of money laundering as part of the corruption network dismantled through Operation Coral and Coral 5G .

According to the Public Ministry, Disla acted as a front man for his son, managing assets and resources obtained illicitly as part of the corruption scheme. Colonel Rafael Núñez de Aza, who was, according to the accusation, the financial head of the network, is identified as one of the main defendants in the Coral and Coral 5G case.

According to the prosecuting body, Núñez de Aza is part of the network that diverted more than 4.5 billion pesos from the State through fraudulent maneuvers, such as the simulation of contracts, the creation of irregular payrolls and the embezzlement of public funds. Part of the stolen resources are hidden through front men, including close relatives such as his mother, Rosa Antonia Disla.

The court also ordered the confiscation of a property located on the Northeast Highway, municipality of Sabana Grande de Boya, Monte Plata province. Which, according to the appraisal presented by the Public Ministry, and accepted by the Third Collegiate Court, has a value of 474,528 dollars.

The property consists of a farm with a four-level green construction, an empty farm without chickens, equipped only with food pendants, and a three-level house in the process of completion.

The property is identified with cadastral numbers 402910321632 and registration number 1200009856, with a surface area of ​​39,951.30 square meters; and 402910339849, registration 1200008438, with an area of ​​10,075.33 square meters.

The sentence imposed on Disla, under the form of suspended prison, includes compliance with several rules, such as maintaining a fixed address, performing 20 hours of community work per month and refraining from carrying firearms.

The Third Collegiate Court also sentenced her to pay the costs of the judicial process and compensation of five million pesos in favor of the Dominican State as compensation for the damages caused.

Prosecutor Jonathan Pérez Fulcar, representing the Specialized Prosecutor’s Office for the Prosecution of Administrative Corruption (PEPCA), highlighted that this sentence represents progress in the dismantling of the Coral and Coral 5G corruption network, reaffirming the commitment to recover the resources stolen from state assets and bring to justice all those involved in these illicit acts.

«We value the court’s decision, since it is one of the few occasions in which a conviction is handed down against a front man or prostitute in a separate trial, although heard simultaneously by another court. “The court demonstrated that the evidentiary elements presented were sufficient to demonstrate the decisive infraction of the accused Rafael Núñez de Aza, which allowed an independent sentence to be imposed on the front woman Rosa Disla,” said Pérez Fulcar.

The Specialized Prosecutor’s Office for the Prosecution of Administrative Corruption was represented by Prosecutors Arolin Lemos Félix and Jonathan Pérez Fulcar. Prosecutors managed to incorporate the evidence that led to the conviction of Rosa Antonia Disla, who was convicted of violating articles 265 and 266 of the Dominican Penal Code, as well as Law 72-02 on money laundering.
