The US suspends Title III of the Helms-Burton Act

SLP, Mexico.- The administration of President Joe Biden suspended This Tuesday Title III of the Cuban Freedom and Democratic Solidarity Law that came into force in 1996 and removed Cuba from the list that designates it as a State sponsor of terrorism.

In the official statement published on the White House website and composed by Joe Biden, the suspension for six months “of the right to file an action under Title III of the Law” was determined.

In his argument, the repeal of the Law “is necessary for the national interests of the United States and will accelerate the transition to democracy in Cuba.” According to the statement, the measure will take effect on January 29, 2025.

Title III of the Helms-Burton Act was created to allow Americans, including
Cubans
nationalized, could sue before US courts the companies that are supposedly benefiting from properties in Cuba that were theirs 60 years ago, before the Revolution.

A senior Biden administration official told Martí News that a list of restricted entities of the Cuban government that cannot do business with the United States was also eliminated, thus revoking Presidential National Security Memorandum 5 of 2017.

The decision would come after a promise from the Havana regime to the Catholic Church to release political prisoners.

The “restricted list” of entities and sub-entities under the control of, or acting for or on behalf of, Cuban military, intelligence or security services or personnel, included companies with which direct financial transactions would disproportionately benefit the regime, at the expense of the Cuban people.

The elimination of this prohibition would give room for financial transactions with the military conglomerate GAESA and other “satellite” companies dependent on it.

Originally, the list included CIMEX, Habaguanex SA, GAESA, Gaviota Tourism Group, UIM (Union of Military Industry), hotels under the direct control of Gaviota; entities directly serving the defense and security sectors, such as ACERPROT, Security and Protection Systems Certification Company, AGROMIN, APCI (Fire Protection Agency), CAHOMA (Comandante Ernesto Che Guevara Military Industrial Company), Casa Editorial Verde Olivo, Editorial Capitán San Luis, DSE (Department of State Security).

Others included are ADESA/ASAT (Customs Services Agency), AIS Remesas, FINCIMEX, Ron Varadero, Banco Financiero Internacional SA (BFI), Empresa Inmobiliaria Almest, Mariel Special Development Zone (ZEDM), Special Zone for Development and Logistics Activities (ZEDAL) ).

Cuba’s removal from the list of sponsors of terrorism

In another advertisement officially, the US Government affirmed that the Cuban regime has not provided any support to international terrorism during the previous six months and has given guarantees that it will not support acts of international terrorism in the future, thereby justifying the departure of the regime from the list of state sponsors of terrorism.

White House officials indicated that the decision could be reversed as early as next week, once President-elect Donald Trump takes office and future Secretary of State, Marco Rubiotake his position as the head of US foreign policy.

Just a month ago, the Counterterrorism Bureau of the United States Department of State, in its Country Report on Terrorism (CRT, for its acronym in English), kept Cuba on the list for harboring several fugitives from US justice wanted on charges related to political violence, many of whom have been residing on the Island for decades.

Cuba, which appears along with North Korea, Iran and Syria on this list, is one of the countries that Washington accuses of giving “repeated support to acts of terrorism international”.

A statement Press Secretary Karine Jean-Pierre concluded that with the measures taken and announced this Tuesday, the dialogue between the government of Cuba and the Catholic Church is reinforced.

In his opinion, this would make it easier for Cuba to take its own constructive measures “to restore the freedom of its citizens” and “allow conditions that improve the livelihood of Cubans.”
