Marlene Paco, the lawyer who processed the house arrest for the serial femicide Richad Choque, articulated a network of judges who favored and released those sentenced for cases of femicide, infanticide, murder, rape and drug trafficking, among others. Yesterday, a third judge was arrested for being involved in this type of case.
“Lawyer Marlene Paco was the one who articulated this consortium of lawyers and judges. According to the investigations we have so far, she was the head, ”a high authority investigating the case told Page Seven.
The third AA judge, who was arrested yesterday for being involved in this network, was in charge of the Fourth Criminal Enforcement Court of the district of La Paz. This justice operator allegedly granted house arrest to Marcelo Alejandro, who was sentenced to 30 years in prison without pardon for murder.
The Anti-Corruption Prosecutor of La Paz Gustavo Balderrama said that the lawyer Paco also defended Marcelo Alejandro. “Initially, Dr. Paco did participate in this process,” he said. He indicated that there are other people involved in the case. “We do not want to give their names because of the same investigation that we are carrying out,” she said.
Paco and the lawyer S. Solari are in preventive detention because -according to the Prosecutor’s Office- they were identified as part of a consortium of judges and lawyers that released those sentenced for femicide, infanticide, murder and rape.
Four other people who were part of the network were also preventively detained: the former First Judge of Criminal Enforcement in La Paz, Rafael Alcón; the former secretary of the Criminal Enforcement Court, Raúl G.; two social workers from the court, Yesica C. and Mary CC; and physician Freddy T.
Balderrama said that in the case of the third judge, the modus operandi was the same: a medical certificate that said incurable diseases was used to give a sentenced person house arrest.
For this reason, the offices were searched and the jurisdictional control notebook was seized, which allows establishing that Judge AA’s Resolution 03/2014 “is prevaricating because in that year he issued that resolution giving house arrest to this prisoner who He had been in prison for 30 years.”
The judge is now being investigated for the commission of the crimes of prevarication, resolutions contrary to the Constitution and the laws, breach of duties and consortium of judges, prosecutors, police and lawyers.
“We will continue with the investigations to determine how many more people would have obtained their house arrest despite being sentenced to 30 years in prison without the right to pardon,” said the prosecutor.
To date, Alejandro has not been recaptured. “We are reviewing the background to find this person. We understand that those assigned to the case are carrying out the investigative acts with reference to this person, ”he indicated. He said that the defendant’s statement will be taken in the next few hours.
The second judge involved in favoring attorney Paco’s clients is José Ayaviri, according to the authorities. This official headed the Third Criminal Enforcement Court and was prosecuted in 2020, but apparently no progress was made.
“Judge Ayaviri was the last authority and the one who revoked the sentencing order for those deprived of liberty,” said a source from Página Siete.
The Public Ministry will verify the Ayaviri process and warned that if irregularities are found, the prosecutor in charge will also be investigated.
The first judge linked to the network articulated by the lawyer Paco is Rafael Alcón, who is currently in preventive detention for favoring four sentenced to 30 years in prison for femicide, murder, rape and drug trafficking.
Yesterday, the director of Fiscal Management, Supervision and Evaluation, Roberto Almendras, said that after concluding with the review of the cases with executory convictions in the Criminal Enforcement Courts of the Court of Justice of La Paz, irregularities were noted by some judges. , in the granting of benefits, such as house arrest for those sentenced to the maximum penalty.
