President Luiz Inácio Lula da Silva sanctioned with vetoes the bill that changes the rules for granting the Continuous Payment Benefit (BPC). The presidential order providing for the changes was published in an extra edition of the Official Gazetteon Friday night (28).
The sanctioned text provides for mandatory biometrics for new benefits and registration updates at least every two years. It also determines that biometric registration must be carried out to receive and maintain retirement and pensions. Currently the requirement is only valid for BPC.
Vetoes
One of the vetoes made by the president, in relation to the text sent by the National Congress, was related to article 6, which limited the granting of the benefit to people who demonstrated medium or severe disabilities. With the veto, the concession also covers those who have a mild degree of disability.
The justification for the veto, presented by Planalto, says that “the legislative proposal goes against the public interest, as it could bring legal uncertainty in relation to the granting of benefits”.
Overturning the veto had already been agreed in the Senate, when the vote on the bill dealing with the BPC took place. Through an agreement, the government committed to vetoing the bill, which had been included in the Chamber.
Under a similar justification, the section that revoked rules for the reinsertion of beneficiaries of the Bolsa Família program was also vetoed: “it goes against the public interest, as it could give rise to legal uncertainty in relation to the eligibility rules for re-entering the Bolsa Família Program”, justified the Plateau.
The benefit, worth one monthly minimum wage, is a right for people with disabilities and elderly people aged 65 or over, if they are unable to support themselves or be supported by their family.
“In the case of a person with a disability, this condition must be capable of causing long-term physical, mental, intellectual or sensory impairments (with effects lasting at least 2 years), which make it impossible for them to participate fully and effectively. in society, on equal terms with other people”, informs the Ministry of Development and Social Assistance, Family and Combating Hunger, on its website.
