The retired general of the Peruvian Army, Juan Rivero Lazo, was released from the Virgen de la Merced prison, in Chorrillos, after spending 25 years in prison for the Barrios Altos case.
Through a statement, the National Penitentiary Institute (INPE) requested his release, in compliance with the resolution issued by the Constitutional Court (TC) on December 17.
Rivero Lazo served as Director General of Army Intelligence between 1991 and 1992 and was sentenced to 25 years in prison for the Barrios Altos case. It is worth mentioning that he has been serving a sentence since 2001.
Likewise, the TC determined that the start of the calculation of the soldier’s sentence for said case attributed to the Colina Group had to begin on December 16, 1993 and end on October 8, 2024.
As they resolved, instead of the period from April 8, 2001 to April 2, 2026.
It is worth mentioning that Juan Rivero Lazo was sentenced as the direct perpetrator of crimes such as qualified homicide, among others.
In conversation with RPP, his lawyer Aníbal Quiroga, indicated that he presented a habeas corpus and also a report of events carried out by the retired general’s daughter.
“The TC by a large majority has declared that it has already complied with its pressure for a long time, that this had to be computed from the year 93 and not later as the Justice System had arbitrarily ordered.“, held.
Then he added that therefore “his immediate release corresponds to him like any citizen”.
“The TC has considered that his current prison situation is already arbitrary and unconstitutional and therefore his immediate release corresponds, which should occur in the next few hours.”, he said.
