The minister of the Federal Supreme Court (STF) Alexandre de Moraes asked former federal deputy Daniel Silveira for explanations this Thursday (26) regarding new accusations of violation of precautionary measures during the fulfillment of conditional release.
In the decision, Moraes gave the former parliamentarian 48 hours to explain why he was away from home for around 10 hours and also went to a shopping mall in Petrópolis (RJ), last Sunday (22). Furthermore, Silveira must inform who was with him.
On Tuesday (24), the former deputy was arrested by the Federal Police (PF) after failing to comply with the rule that established the 10pm time for night collection. The measure was established in the conditional release, a benefit that was revoked by Moraes after the episode. According to the minister, last weekend, Daniel Silveira was admitted to a hospital, without judicial authorization.
In the new decision handed down today, Moraes wants explanations about Daniel Silveira’s stay in other locations that were discovered after the Rio de Janeiro Penitentiary Administration Secretariat sent the minister data on the monitoring of the electronic ankle bracelet.
According to Moraes, Daniel Silveira could not spend the day outside his residence. In the minister’s understanding, the behavior demonstrates that Silveira “ignored” the conditions of parole.
“Among numerous other addresses visited, the convict spent more than an hour in the shopping mall (occurrence 14, date: 22/12/2024, arrival: 13:12, departure: 14:16), reinforcing the absence of any serious health problem , as falsely alleged by his defense”, wrote the minister.
After the decision to suspend his parole, Daniel’s defense said that he had to be taken to Hospital Santa Tereza, in Petrópolis (RJ), on Saturday (21), with severe back pain and added tests and a certificate to prove that he received medical care.
In 2023, Silveira was sentenced by the STF to eight years and nine months in prison for the crimes of attempting to prevent the free exercise of powers and coercion during the process by making insults and threats against the Court’s ministers.
Last week, Moraes authorized conditional release from the sentence, but the benefit was revoked after non-compliance with precautionary measures.
