The National Penitentiary Institute (INPE) issued a statement in relation to the release of Juan Nolberto Rivero Lazo, in compliance with a ruling from the Constitutional Court, corresponding to a habeas corpus process.
As is known, the highest interpreter of the Constitution determined that the beginning of the calculation of the sentence for the Barrios Altos case should begin on December 16, 1993 and end on October 8, 2024; instead of the period from April 8, 2001 to April 9, 2026.
Rivero Lazo, who served as director of the Army Intelligence Directorate (DINTE), between 1991 and 1992, was sentenced to 25 years in prison for the cases attributed to the Colina Group.
On Monday, December 23, 2024, at 1:12 pm, the Penitentiary Registry Subdirectorate of the Lima Regional Office of the INPE received, through the Judicial Secretariat of the Ninth Constitutional Court of Lima, the Superior Court of Justice of Lima ( CSJL), the judicial order for the release of Juan Nolberto Rivero Lazo.
Given this, the INPE identified the need to request clarifications to ensure correct compliance with the judicial mandate. Therefore, the following communications were sent: One letter to the Ninth Constitutional Court of Lima and two letters to the Presidency of the Superior Court of Justice of Lima.
At 10:09 am on December 24, the Ninth Constitutional Court of Lima responded to the INPE request. The response from the Superior Court of Justice of Lima was pending.
Finally, at 12:44 pm of the same day, the Penitentiary Registry Subdirectorate of the Lima Regional Office informed the Ninth Constitutional Court of Lima that the execution of the release order had been carried out. after verifying that the inmate had no other pending judicial proceedings that would prevent his release.
The INPE emphasized that its function is limited to executing judicial resolutions. “It is not authorized to interpret, question or assume the content of said resolutions,” the statement reads.
