10 years after the death of the prosecutor, Justice wakes up from its lethargy
The origin of the complaint dates back to March 2015, when Elisa Carrió appeared before Justice. In his presentation, to which LA NACION had access, Carrió warned that in Nisman’s department “there would have been a withdrawal of the custody assigned to him” by the prosecutor and “a decrease in the controls that the security personnel of the company ‘Comprehensive Business Security’”.
For this reason, the complainant asked to investigate whether there was a “liberated zone” in the Le Parc towers to achieve the murder of Prosecutor Nisman.
In this sense, he expressed that Nisman’s guards not only left him without protection during the weekend in which he was shot, but due to Nisman’s lack of response, “they did nothing to repel any imminent risk that could be threatening him.” ”.
Carrió asked before the Justice if the shortcomings in Security responded “to the existence of an order to relax custody and delay entry to Nisman’s apartment,” or “to the decision by the hierarchical personnel to hide what was happening.”
At the same time, in a report released by the program Periodismo Para Todos (PPT), hosted by Jorge Lanata, other disasters at the crime scene were revealed.

The images showed some errors that were made during the preservation after the discovery of the body. The oversights have to do with protocol failures, the handling of evidence without gloves (for example, when taking fingerprints of objects and when removing money and documentation from the safe), the excess of people at the scene of the incident, work without care on the part of the experts about elements that could have contained crucial fingerprints for the investigation.
In different radio interviews, the then prosecutor Viviana Fein, in charge of the investigation, insisted that it had not been contaminated and assured that she was not “concerned” nor does it affect her “at all” that the Federal Police images of the incident were disseminated. work of experts.
Below is a review of the irregularities in the procedure:
1) There is no perimeter fence. As reported by LA NACION when the photographs of the procedure came to light, specialists warn that a perimeter fence must be made at the place where a possible crime was committed, which is divided into three sections: “expert perimeter”, “judicial-police ” and “public”. Only the prosecutor, witnesses and forensic experts can enter the first perimeter. Police officers, judicial officials and some experts work in the second.
According to the video shown by Lanata’s program, the Federal Police did not carry out the perimeter fencing in Nisman’s department.
2) Large number of people. Images captured by security forces in Nisman’s apartment in the Le Parc towers show a large number of people at the scene of the incident. For specialists, the excess of people generates a high risk of contamination of the scene.
3) Without adequate protection. According to experts, all the people who entered the home of the prosecutor in the AMIA case should have used adequate protection (suits, mask, gloves, foot and head coverage) to “guarantee that evidence is not lost or altered, that no elements are incorporated into the scene, that it does not contaminate the place.”
4) The presence of Berni. The images of the procedure released last night show the Secretary of Security, Sergio Berni, standing between experts and police officers in the kitchen of the department. In addition, a dialogue between the official and prosecutor Fein could be heard. A long time after arriving at the scene, Berni urged the prosecutor to verify if Nisman was still alive or dying.
6) Handling evidence without gloves. The video shows how an expert removes money and documentation from the safe without gloves.
7) Little care with the weapon. PPT showed that the experts were careless about elements that could have contained crucial fingerprints for the investigation. Among others, the 22-caliber Bersa Thunder gun from which the shot that killed Nisman came from computer technician Diego Lagomarsino. No traces were taken from the non-bloody side.
8) The magazine and bullets. You can also see the same expert handling the bloody weapon, removing the magazine and bullets and placing them on the bidet, without changing his glove.
9) They stain the bidet. The expert places the bullets and the magazine that he had touched with the bloody glove on the bidet.
9) They clean the weapon with their finger. An expert cleans the Bersa gun with his finger to verify the make, model and numbering. He has a glove on.

10) Toilet paper. An expert uses toilet paper from Nisman’s bathroom to clean the gun.
11) A video with cuts. The police video contains cuts, when, according to the program, the correct thing in these cases is for it to be filming without interruptions.
12) Fein steps on the blood stains. At one point in the video, you can see how prosecutor Fein steps on the blood stains in the bathroom where Nisman’s body was found.
13) The garbage. The images also show the moment when experts review the contents of the garbage can. They take out the leftover food and place it on a kitchen table.
14) Without gloves. An expert lifts fingerprints off the door without gloves.
