President Luiz Inácio Lula da Silva signed this Monday (23) the Christmas pardon for 2024. In this year’s edition, published in an extra edition of the Official Gazette, priority was given to convicted people who belong to groups that are in a vulnerable situation, such as the elderly , pregnant women, people with disabilities or serious illnesses, such as HIV-positive or terminally ill inmates.
The pardon of the sentence will benefit pregnant women with high-risk pregnancies and mothers and grandmothers convicted of crimes without serious threat or violence who can prove that they are essential to guarantee the care of children up to 12 years of age.
The pardon may also be granted to inmates with severe autism spectrum disorder and inmates who are paraplegic, quadriplegic and blind.
President Lula’s decree does not apply to those convicted of crimes against the Democratic Rule of Law (such as the coup acts of January 8), heinous crimes, torture, terrorism, racism, money laundering, concealment of assets, violence against women , children and adolescents.
Members of criminal factions, people convicted of abuse of authority and who signed plea bargain agreements are also excluded from the pardon.
The rules of the decree were drawn up by the National Criminal Policy Council and validated by the Minister of Justice and Public Security, Ricardo Lewandowski.
According to the Constitution, the President of the Republic has the power to issue the pardon. The rules are reviewed every year.
