Prosecutor’s Office presents lawsuits before the TC against laws approved by Congress

The Prosecutor of the Nation, Delia Espinozapresented two unconstitutionality lawsuits to annul the statute of limitations for crimes against humanity and the rule that allows the National Police to carry out preliminary investigations.

The Prosecutor’s Office reported in a statement that both appeals were filed before the Constitutional Court.

Espinoza alleged that the first law violates the right of access to justice, to the truth, to due process, to equality; just as it ignores the obligation of the State to respect, protect and guarantee the full validity of human rights.

He stated that the classification of conduct as against humanity can only be made from the validity (July 1, 2022) of the Rome Statute of the International Criminal Court of Peru and the Convention on the imprescriptibility of War Crimes of the Crimes Against Humanity (November 9, 2003).

About the second lawargued that only the Public Ministry is in charge of criminal action and, therefore, conducts the investigation of the crime from the beginning, to be able to formalize and accuse with police assistance.

Other points that represent a cause of unconstitutionality, the statement says, are those that establish that the investigation must necessarily be carried out with the intervention of the National Police of Peru and that which indicates that, between the Public Ministry and the PNP there will be relations of ” joint coordination.”
