He Constitutional Court (TC) declared founded the habeas corpus demand presented by the defense of the former head of the Joint Command of the Armed Forces, Nicolás de Bari Hermoza Ríos, in order to release him for “humanitarian reasons.”
Within the resolution, the Judiciary and INPE are urged to take the necessary actions to free him. However, the TC clarified that this ruling does not annul the convictions or exempt him from paying the pending civil compensation.
Among the grounds approved by the magistrates, humanitarian reasons are appealed given that the former general suffers from senile dementia.
As is known, Nicolás Hermoza Ríos was convicted of the crimes of illicit enrichment, embezzlement and corruption of officials; added to human rights violations that link him to the massacres of Barrios Altos, El Santa and Pedro Yauri, which occurred during the mandate of Alberto Fujimori.
