The Attorney General’s Office (PGR) sent this Friday (20) to the Federal Supreme Court (STF) an opinion against the release of General Braga Netto, arrested last weekin Rio de Janeiro, as part of the investigations into the coup investigation.PGR sends opinion to the STF to maintain Braga Netto's arrest

The demonstration was motivated by a request from the general’s defense for the prison to be replaced by measures other than prison. The lawyers also claimed that the accusations that Braga Netto participated in the coup plot during the government of former president Jair Bolsonaro deal with past events and there is no contemporaneity to justify preventive detention.

For the attorney general, Paulo Gonet, the reasons that supported the general’s arrest remain valid. According to Gonet, precautionary measures are not sufficient to guarantee public order, convenience of criminal investigation and to ensure the application of criminal law.

“The attempts by the person being investigated to embarrass the ongoing investigation denote the indispensability of the extreme measure, given that only the segregation of the aggravating factor can guarantee the cessation of the practice of obstruction. The factual framework thus denotes a risk of continued criminal activity on the part of the person being investigated, which brings the species an element of contemporaneity”, explained the prosecutor.

On Saturday (14), Braga Netto was arrested by order of minister Alexandre de Moraes, rapporteur of the coup investigation, which is being processed in the Court.

According to investigations by the Federal Police, the retired general and vice-president on Bolsonaro’s 2022 ticket would be obstructing the investigation into the attempted coup d’état in the country to prevent the inauguration of Luiz Inácio Lula da Silva.

The Federal Police identified that the general, indicted for being one of the main organizers of the coup plot, tried to obtain confidential data from Mauro Cid, Bolsonaro’s former aide-de-camp.

After the arrest, the defense denied that Braga Netto obstructed investigations.
