The Popular Renewal bench presented a bill so that terrorists do not receive any prison benefits.
“We cannot allow terrorists to be rewarded. These criminals murdered innocent Peruvians, destroyed families and almost ruined our economy. The aforementioned legislative project proposes to modify article 22 of the current law, entitled ‘Responsibility restricted by age’, and include this new text: “Those over eighty years of age, for humanitarian reasons, will face their sentence in accordance with the scope of article 288 or article 290 of the New Criminal Procedure Code, Legislative Decree 957. Those sentenced for the crime of terrorism are exempt from this benefit.”
“The exclusion of terrorists from the benefits contemplated in Article 22 of the Penal Code is essential to preserve national security and the democratic order in Peru,” indicates the text of the project.
As recalled, the recent approval of Law No. 32181 by the Legislature brought with it an intense debate about its implications. This is because this regulation allows convicted persons over 80 years of age to request that their sentences be served outside of prison, under modalities such as house arrest or freedom with restrictions, as long as a judge authorizes it.
The change, which modifies article 22 of the Peruvian Penal Code, included humanitarian criteria in the execution of sentences, citing advanced age as the main basis, that is, 80 years of age.
However, this provision could be extended to people convicted of serious crimes such as terrorism, rape, drug trafficking and even those serving life sentences.
