Vladimir Cerrón will request an end to preventive detention after his sentence is annulled

The Constitutional Court (TC) declared a habeas corpus appeal founded and annulled the sentence of three years and six months of effective prison imposed on the leader of Peru Libre, Vladimir Cerrón, for the Wanka Aerodrome case. “He has resolved to declare the habeas corpus claim founded; Consequently, the hearing ruling dated October 6, 2023, with respect to the beneficiary of this lawsuit, is null and void, at the end of its operative paragraph three, which declares the exception of the criminal action unfounded, and a new resolution must be issued,” reads in the document. Precisely since that date, the former governor of Junín has been a fugitive from justice.

“I am sentenced for a prescribed case”

Vladimir Cerrón spoke with Correo about this. “The prosecution sentences me in October 2023, that is, outside the deadline, in a prescribed case. My right as a defendant was violated, ignoring the political nature; That sentence should never have been given, that motivated me to go underground, and later they imposed preventive detention on me for the other cases, and for not complying with the rules of conduct, which is to sign, but I did it to safeguard my freedom, against to an arbitrary and unconstitutional sentence”, he noted.

In its ruling, the TC concluded that the Junín Appeals Chamber violated the right to due motivation of judicial resolutions by not specifying whether the crime of simple collusion, for which Cerrón was convicted, was instantaneous, continuous or permanent. . This distinction is key to determining whether the statute of limitations for the criminal action had expired.

“The preventive detention sentence for the Antalsis and money laundering case in Lima is imposed because I am not going to sign, not because new elements appeared, or because the cases have worsened,” he said. He announced that he will request the end of preventive detention, “which should happen soon if there was legal speed and there was no politicization.” which according to him has dirty Peruvian justice.

Judges Helder Domínguez, Francisco Morales, Gustavo Gutiérrez and Pedro Hernández voted in favor of Cerrón Rojas’ appeal. Judges Luz Pacheco, César Ochoa and Manuel Monteagudo voted against.
