He Ministry of Economy and Finance (MEF) approved the complementary regulations to transfer to the Pension Normalization Office (ONP) the administration and payment of pensions included in the regime of Decree Law No. 20530.
The measure was published this Thursday through Supreme Decree No. 263-2024 and details that the entities that administer and pay pensions, as well as other concepts that pensioners receive, are included in the regulation.
Likewise, it indicates that the General Directorate of Fiscal Management of Human Resources of the MEF establishes each year, and progressively, the entities included in the pensioner transfer schedule. In that sense, the highest administrative authority and the head of human resources is responsible for compliance with the measure.
It is stipulated that the entities included must send to the ONP the information and documentation on the recognition and pension payroll, as well as pending judicial processes.
To do this, the entities transfer to the pension agency the information contained in the payment forms of their pensioners under the regime of decree No. 20530, the documentary collection related to the recognition of the pensioners’ right and any other documentation necessary to administer and pay the pensions. .
The norm establishes that entities have permission to, in exceptional cases, issue a document that recognizes pensioners who are already receiving pensions but who do not have documentation that definitively confirms their pensioner status.
This text must include the amount of the pension and details about the concepts that make it up. Furthermore, this information must be recorded in the computer system intended for the centralized management of payrolls and human resources data in the public sector.
This is applicable in cases where the termination of former employees incorporated into the regime of Decree No. 20530 has occurred before July 1, 2008. In this sense, it indicates that the resolutions must be sent to the ONP with the respective supporting documentation.
