The Prosecutor of the Nation, Delia Espinozaconfirmed that the Public Ministry does have powers to investigate President Dina Boluarte for the alleged crime of omission of duties, after revealing that a surgical intervention would have been performed in mid-2023.
“She is a lady with a function that constitutes a position of registered officer, therefore, the National Prosecutor’s Office that it is up to the speaker if he is competent to be able to investigate it with all the guarantees of due process,” he told Canal N.
In this context, he asked that Congress not enact any more reforms that undermine its public function. “Just as we comply with the law, we also ask that the laws not continue to be modified, which means a clear setback in the fight against crime,” he said.
Regarding the latest tax investigation against the president“the facts refer to the failure to communicate the temporary impediment to the exercise of the office of President of the Republic to the Council of Ministers and Congress, from June 29 to July 9, 2023, as a consequence of a surgical procedure that was subjected”.
This investigation begins after the statement of former Prime Minister Alberto Otárola, who told the Congressional Oversight Commission that the president had been absent in June of last year due to a surgical intervention she underwent.
According to Otárola, the president was away from any public event for ten days due to that surgery. That is, he did not hold office in person during that period.

Delia Espinoza rejects Dina Boluarte’s proposal on the death penalty
At another time, the Attorney of the Nation made known his opinion on the death penalty proposal for rapists raised by Dina Boluarte. In this regard, Espinoza explained that it is not a viable measure because Peru is registered in the San José pact. Furthermore, he recalled that, in practice, judicial errors can be made.
“We cannot have a setback in that sense and let us not forget that if the death penalty is implemented in Peru there may also be judicial errors. What happens if there is a subsequent review, we must think things through very carefully, we must debate these issues who are sensitive,” he explained.
