Constitutional Court declares the law that creates the DNI unconstitutional

Santo Domingo. – The Constitutional Court of the Republic annulled this Friday Law 1-24, which establishes the creation of the National Intelligence Directorate (DNI), when considering that it is “not in accordance with the Constitution.”

In the Sentence TC/0767/24, released today, the court accepted the direct action of unconstitutionality presented by the People’s Force, the Dominican Liberation Party (PLD) and the Dominican Revolutionary Party (PRD), which challenged the law before the Constitutional Court.

In its ruling, the Constitutional Court argues that, despite having been approved by a large majority, Law 1-24 was not processed as an organic law, which is necessary for its validity.

“This constitutional court determines that Law no. 1-24, regardless of the majority with which it was sanctioned and the subject matter it dealt with, was definitely not approved as organic. “That was not the legislative treatment it received nor was that the intention of the National Congress,” the court states in its resolution.

Questions to the Law

The text was questioned by the SDD and other civil society organizations, after part of its content was made known, which included an authorization to deliver information to the DNI without specifying that said action had to be through the intermediation of a judge.

In defense of the project, the ruling party legislators argued that the law itself embodies in its principles the obligation to respect all procedural norms, as well as constitutional guarantees.

It has also been questioned that it contemplates sentences of up to three years in prison for those who do not provide data.
Regarding this, Peralta said that he assumed shared responsibility since the director of the DNI worked with his technical team on the project and then it was reviewed in the Consultancy.

In any case, he pointed out that it was not unconstitutional as some alleged but that there were ambiguities in its wording.

If the report is completed according to the forecast, the text would be forwarded to Congress.

He indicated that the commission’s work was slow and that what was sought was to be able to go to elections under the current conditions.
