CCJ approves text that allows states to legislate on criminal matters

The Constitution, Justice and Citizenship Committee (CCJ) of the Chamber of Deputies approved this Wednesday (4) a bill that allows states and the Federal District to approve specific laws on criminal and criminal procedural matters.CCJ approves text that allows states to legislate on criminal mattersCCJ approves text that allows states to legislate on criminal matters

According to the text, which still needs to pass through the plenary, states and the Federal District are authorized to legislate on the following issues, as long as it is in a more serious manner than that provided for in federal legislation:

– setting penalties for crimes provided for in the current legal system, respecting the time limit for serving custodial sentences provided for in the Penal Code;

– sentence serving regimes, their types, rules for establishing the initial regime and progression;

– requirements for granting conditional release, conditional suspension of sentence, conditional suspension of proceedings and criminal settlement;

– types and forms of enforcement of penalties restricting rights;

– criteria for replacing the custodial sentence with a sentence restricting rights; and

– prediction of generic and specific effects of the conviction.
