The Attorney General’s Office This Wednesday he issued a formal request to the National Superintendent of Health, Giovanni Rubianorequesting all supports and minutes that supported the appointments of the intervening agents of the health promoting entities (EPS) and that ended up deviating from the procedure regulated in the Registry of Auditors, Liquidators and Comptrollers (Rilco).
It should be explained that Rilco is a list of names those who have been proven to have a set of qualities, abilities, techniques and experiences sufficient to participate in intervention processes. However, the superintendent would have chosen the current auditors without taking into account this list of candidates.

However, the Attorney General’s Office explained that the regulations, Although it allows the health superintendent to make discretionary exceptions in the selection of interveners, these must be motivated and subject to the principles of rationality and proportionality.. This guideline is established by article 44 of the Code of Administrative Procedure and Administrative Litigation (CPACA).

Therefore, the Public Ministry stated that, although discretionary measures are contemplated by law, they cannot be adopted arbitrarily or without foundations. This figure exists to guarantee that appointments comply with the principles of transparency and accountability.

“In the cases of takeover of the EPS Savia Salud, Asmet Salud, Emssanar, Famisanar, Nueva EPS, Sanitas and Coosalud during the years 2023 and 2024, Supersalud has made use of the discretionary power to deviate from Rilco invoking the discretionary power“, mentioned the Attorney General’s Office.

The control entity specified that the intervening agents in question are Diana Constanza Rodríguez Posso (Savia Salud EPS), Gloria Libia Polanía Aguillón (Asmet Salud), Gabriel Enrique Castilla Castillo (Emssanar EPS), Jorge Arturo Suárez Suárez (Famisanar), Bernardo Armando Camacho Rodríguez (Nueva EPS), Kemer Ramírez Cárdenas (EPS Sanitas) and Gladys Séfora de las Mercedes (Coosalud EPS).
