The defense of the couple accused of harassing Minister Alexandre de Moraes, of the Federal Supreme Court (STF), at Rome airport, in Italy, in 2023, filed a request for retraction with the Court.
In July this year, the Attorney General’s Office (PGR) reported to the STF the couple Roberto Mantovani Filho and Andrea Mantovani and their son-in-law, Alex Zanatta, for the crimes of insult and slander.
According to the prosecutor’s office, the accused offended Moraes with insults such as “thug”, “bought”, “communist” and “thief” and “election fraudster”. The offenses occurred when the minister, his wife and three children were in the airport departure lounge.
In the request sent to the Supreme Court, the lawyers inform that the accused wish to recant with the victims.
The request will be analyzed by Minister Dias Toffoli, rapporteur of the case.
Retraction in cases of crimes against honor is a legal strategy permitted by criminal law to end the process before sentencing. If the retraction is not accepted by the rapporteur, the accused will go to trial and may be convicted.
There is no deadline for Dias Toffoli to decide the issue.
