Ombudsman must go to Congress

The Ombudsman, Josué Gutiérrez, will have to explain in Congress whether the support he has given in a public statement to the dissolved National Alliance of Workers, Farmers, University Students, Reservists and Workers (ANTAURO) party for actions that violate the democracy, he did so in his personal capacity or on behalf of the entity he represents; and, furthermore, about the conflict of interest that he would have with that group after El Comercio reported that his brother Agustín Gutiérrez is an Antaurist militant.

The congressman from Renovación Popular, Esdras Medina, told Perú21 that he will request the president of the Oversight Commission, Juan Burgos, that Gutiérrez be summoned to the session on Friday the 29th, or to an extraordinary session, to give his defense, as stated. The president of the Constitutional Court, Luz Pacheco, made last Friday after this media revealed that she met with Antauro Humala.

For his part, the spokesperson for the Honor and Democracy bench, José Cueto, told this medium that his parliamentary group, through its representative on that commission, Congresswoman Gladys Echaíz, supports said summons.

The congresswoman from Fuerza Popular and member of the commission, Vivian Olivos, in communication with Perú21, rejected Gutiérrez’s statement, and recalled that although her group supported his appointment, through their votes in the Plenary Session, this time they will support the start of any investigation against him if he does not recognize his mistake.

“My caucus will meet shortly, and we will discuss this issue and the actions that will be taken,” he said.

On the other side, the non-grouped legislator and member of the Audit Office, Carlos Zeballos, considered that he must first be asked in writing to respond if his statement was as an ordinary citizen or as an authority; If he did it as a defender, “he will have to be summoned.”

-The dissolved ANTAURO party has asked the People’s Defender to be amicus curiae to give an opinion on its illegality.

-Gutiérrez said that declaring the party illegal was “an abuse of rights.”

-“He cannot be an amicus curiae or make a report (from ANTA.URO), he is disqualified from doing that,” said constitutionalist Aníbal Quiroga.
