Supreme Judge Saúl Farfán Peña supported the vote of judges Albatás Kajatt and Carbajal Chávez, in declaring the appeal formulated by the representative of the Public Ministry founded.
“They revoked the order of October 2, 2024, issued by the Supreme Preparatory Investigation Court, to the extent that it declared the preventive detention requirement against Luz Elizabeth Peralta Santur to be unfounded and imposed an appearance with restrictions,” it can be read in the document issued by the Supreme Court of Justice.
With it, The Judiciary must convene a new supreme judge to decide whether or not to dictate 18 months of preventive detention against the suspended senior prosecutor Elizabeth Peraltaas part of the preparatory investigation being followed together with former Television host Andrés Hurtado, known as ‘Chibolín’, for the alleged crimes of influence peddling and specific active bribery to the detriment of the State.

It should be noted that at the Supreme Court level, four votes are required to adopt a majority decision on an incident pending resolution. Since there is a disagreement in this case, in the coming days another supreme judge will be summoned to evaluate said tax appeal so that the necessary votes can be reached to adopt a decision in this regard.
According to the document, the court agreed to call Supreme Judge Saúl Peña Farfán to resolve the appeal, and called a hearing to be held next Wednesday, November 20, at 3:00 pm
Regarding the investigated prosecutor Luz Elizabeth Peralta Santur, there is still no agreement, because 4 votes are required. There are 3 votes to confirm the appearance and 2 votes to order preventive detention for 18 months. (3/4)
