Martín Vizcarra insists on being able to leave Lima without judicial permission

As is known, on November 8, Judge Ubaldo Callo Deza declared this same request, which Vizcarra formulated through his legal defense, unfounded. The former president has appealed that resolution, mentioning that the judge has made a series of errors when issuing his resolution, such as indicating that the fundamental rights of his client were not being seriously affected.

On November 19, Callo Deza granted the appeal and sent it to the Third National Criminal Appeals Chamber, a body that must admit it for processing and subsequently convene a virtual hearing in which it will be evaluated, with the participation of the parties involved.

At the time, the magistrate maintained that the order against Vizcarra by which he is obliged to request permission before leaving Lima is intended to ensure that he is always available to the judicial authority to carry out procedural acts typical of the criminal process. such as the development of the oral trial.

“It is logical to assume that when a person leaves their town they will not be able to be easily found to participate in the procedural act required of them in the oral trial, generating a certain procedural danger,” he said.

The magistrate specified that it cannot be argued that Vizcarra’s rights have been seriously restricted, since from the moment the rule of conduct was imposed on him the court has been authorizing departures from the town where he resides, Lima, when there were reasons. founded.

CONFIRM MEASURE

On the other hand, the Judiciary also confirmed the precautionary measure of inhibition of 15 properties in the name of former President Vizcarra, and his wife, former first lady Maribel Díaz. As reported by the Superior Transitory Prosecutor’s Office Specialized in Domain Forfeiture of Lima, these properties, whose total value amounts to S/5,810,252, are located in Lima and Moquegua.

The properties would be linked to the alleged acts of corruption that the former president would have committed when he was governor of Moquegua between 2011 and 2014, for which he has been investigated within the framework of the so-called Lomas de Ilo and Hospital Moquegua cases.
