Minister of the Federal Supreme Court Alexandre de Moraes relaxed the precautionary measure that determined the night and weekend home confinement of former Minister of Justice Anderson Torres, so that he can accompany his mother, Amelia Gomes da Silva Torres, in the necessary care to cancer treatment.
The provisional authorization granted this Saturday (23) by Moraes is limited to the investigator’s travel from his residence, in the Lago Sul neighborhood, in Brasília, to his mother’s residence, in Lago Norte, also in Brasília, or to go to the hospital, where is hospitalized.
In the request to revoke the precautionary measure of home confinement at night and on weekends, made this Thursday (21), Anderson Torres’ defense argued that his mother, aged 70, “suffers from a very serious and incurable illness (cancer)” and that the former minister’s father, due to his advanced age (73 years old), is unable to take care of her alone.
Anderson Torres was arrested in January last year on charges of failing to act to prevent and repress the attacks January 8, 2023 scammerswhen he was Secretary of Public Security for the Federal District in the government of Ibaneis Rocha. On the day of the attacks on the headquarters of the Three Powers, in Brasília, the former secretary was traveling to the United States. In May of the same year, the magistrate granted provisional freedom.
Decision
In the decision, the Supreme Court minister emphasizes that the revocation of the night and weekend gathering order is provisional and, furthermore, that Anderson Torres is not exempt from complying with the other precautionary measures previously imposed.
The Criminal Executions Court of the Federal District must also be notified to adopt measures, including sending the weekly monitoring reports of the person under investigation to the STF.
Minister Alexandre de Moraes recalled that he granted Torres provisional freedom in May 2023, with precautionary measures in place:
· prohibition on being absent from the Federal District;
· use of an electronic ankle bracelet;
· home collection at night and on weekends;
· immediate removal from the position of Federal Police delegate, until a subsequent decision by the STF;
· obligation to appear before the Criminal Executions Court of the Federal District every Monday;
· delivery and cancellation of passports;
· immediate suspension of possession of a firearm in the name of the person being investigated, including functional weapons;
· Prohibition of using social networks and communicating with others involved in the investigation, among others, for the crimes of criminal association, attempted violent abolition of the democratic rule of law and coup d’état.
