After seven months and nine days of being suspended as head of the High Complexity Crime Investigation Division (Diviac) of the National Police, the PNP Colonel Harvey Colchado Huamaní was acquitted of the false charges that they accused him of as a pretext to remove him from his duties.
A few days after directing the judicial search of the president’s homeDina Boluarteas part of the investigations by the Rolex casethe General Inspectorate of the PNP He opened a disciplinary process against Colchado for alleged “very serious” misconduct.
The officer was credited with having mocked the figure of the head of state with a birthday cake that depicted the raid. Colchado always denied it. With the resolution of the Inspectorate, Colonel Harvey Colchado must be immediately reinstated in office.
In accordance with the resolution signed by the head of the Disciplinary Office of the Investigations Directorate of the General Inspectorate of the PNP, Colonel Giovanni Osorio Elguera, to which La República had access, the Republic decided to leave without effect the measure that produced the relief of Colchad as head of the Diviac.
He must return as head of the Diviac.
“To order the lifting of the preventive measure of temporary separation from office imposed on Colonel Harvey Colchado (…)”, reads the document dated November 21 of this year.
As is known, on April 13, Colonel Giovanni Osorio himself notified Colonel Harvey Colchado that he was temporarily suspended from his position as head of the Diviacfor having published on his WhatsApp account the photo of a birthday “cake”, which supposedly “celebrated” the raid on the residence of President Boluarte, in Surquillo, between March 29 and 30 of this year.
Initially, the Inspector General opened two investigations against Colonel Colchado and subjected him to a disciplinary process for “very serious” and “serious” infractions, in accordance with the Regulations of the Disciplinary Regime of the National Police.
The “Very Serious” or “MG-92” infraction is for disseminating images and others related to the service or personnel of the National Police by any means, affecting the institutional image of the National Police, whose sanction is 1 to 2 years of availability.
“Serious” or “M-53” is for participating in activities that denigrate the authority of the Police or institutional image, the penalty for which is 2 to 6 days.
One of the arguments of the head of the Disciplinary Office No. 17, Colonel PNP Giovani Osorioto remove Harvey Colchado from office, was that, if he remained in office, he could obstruct or affect investigations and the collection of evidence or influence the personnel under his command.
However, during the investigations, Colonel Colchado provided a series of evidence and witness testimonies that disproved all of the Inspector General’s accusations.
One of them is the statement of PNP non-commissioned officer Lesly Poma Pimentel, who stated that the cake was designed and coordinated with non-commissioned officer Itamar Para Pérez, and that it was a gift for Colonel Colchado’s birthday. He didn’t intervene at all.
On the other hand, an expert report of forensic descriptive image analysis, prepared by retired PNP colonel Juan Leiva Pimentel, concluded that he found absolute discordances that do not allow establishing a relationship between the image of the cake with another image of the front of the house. the president (Dina Boluarte).
On September 10, 2024, the Decentralized Inspectorate of the PNP issued a resolution acquitting Colonel Harvey Colchado of the “Very Serious” infraction, but he was punished with 4 days of rigor for the “serious” infraction, the sanction of which was appealed. before the Police Disciplinary Court of the Ministry of the Interior and will be resolved in the coming days of November. ❖
