In statements to RPP, Gutiérrez anticipated that the Ombudsman’s Office will publish a “strong and very legal report” regarding the declaration of illegality of the ANTAURO party by the Judiciary.

And although he did not want to give details of its scope, his words made it clear that the document would contain a statement against the judicial provision.
“Political organizations per se do not commit crimes, their representatives may be, but I give you a simple example of the tens of thousands that can be registered in that party. If one of them aspired to run for congressman, governor, mayor, the eliminating that party is harming that person. Whoever joined the group did not do so for Antauro Humala but for the ideology, the program, what it represents legally and publicly,” he indicated.
In this context, Gutiérrez questioned whether the possibility of applying for the militants of that group is being taken away.

“Do you know what that is called? Abuse of rights, and I, as a Defender, can tell you that we are against all types of rights, the instrumentalization of justice, the demand that someone do whatever they want to those who believe they have the exercise of power. They can tell me anything, but our decision will prevail because it has the support of the law because it gives them the right to participate in politics,” he said vehemently.
When asked if he believes that Antauro Humala – who served prison time for the murder of 4 police officers during the ‘Andahuaylazo’ – should apply, he refused to answer.
“I am referring to tens of thousands of people who have registered in a party with the dream of participating actively, to be elected and to choose, it is a constitutional right that neither the Judiciary nor anyone else can proscribe; that is called abuse of right , and I say it with all its letters, the abuse of rights in a democratic state must be prohibited,” he noted.
In a defiant tone, the former Humalist parliamentarian added that the institutional opinion on the issue will be published in the next few hours. “Some people will like it and others will not like it, but I am convinced of something: objectivity is what has to prevail when exercised by legal function and analysis,” he said.
