When the agenda of projects to be discussed in the plenary session of Congress was already determined, The spokespersons of the parties added a proposal that seeks to eliminate the National Board of Justice (JNJ)which appoints and dismisses judges and prosecutors, replace it with another entity and establish that the Legislature appoints the head of the National Elections Office (ONPE).
The spokespersons for Fuerza Popular, Alianza para el Progreso (APP), Perú Libre, Renovación Popular, Acción Popular, Juntos por el Perú and Honor y Democracia supported adding the project to eliminate the JNJ to the agenda and, in its replacement, create the National School of Judiciary, which would appoint judges and prosecutors.
The School will be made up, if the law is achieved, of an active or retired supreme judge, an active or retired supreme prosecutor and a former university rector.
The initial project was by Congresswoman Gladys Echaiz, of Honor and Democracy, who was the Nation’s Attorney during the second government of Alan García. That is, she is a dismissed prosecutor.
In addition, it says that the Senate of Congress appoints the heads of ONPE and Reniec (National Identity Registry), two entities of the electoral system. This alerts a possible influence on the general elections.
The JNJ has expressed its “concern about the speed with which this project has been approved in the Constitution Commission” which it considers “a setback because it gives the full chamber of the Judiciary and the board of prosecutors the power to elect judges and prosecutors, respectively, running the risk of perverting the justice system, as happened in the past.”
