Data protection policy does not affect press freedom

The presiding judge of the Court of Appeals for Children and Adolescents of La Vega, Bernabel Moricete Fabián, assured that the data protection policys recently published by the Can Judicial and that has not come into force, does not violate the freedom of press nor access to information public.

This includes anonymizing or excluding data irrelevant that do not affect the sentence or its execution, such as information of location or elements without relevance to the case.

“The policy guarantees that data personal are managed responsibly, respecting the dignity of people, without affecting fundamental rights such as freedom of press and of information“, concluded the magistrate.

Furthermore, he noted that this policy does not interfere with the functions of the Ministry Public nor with its power to inform. “Whatever he does Ministry Publicwithin its powers and under the constitutional mandate, is not regulated by this policy. The regulations only apply to mandatory publications of the Power Judicial“he stated.

Regarding access to hearings and trials, he clarified that the rules established by the Code Procedural Penal Code and the Constitution remain unchanged, allowing the press access relevant cases under established conditions.

In that order, the magistrate guaranteed the press that the Power Judicial is your ally and recipient because it is also guarantor of the freedom of press. “We are going to defend at all costs the freedom of press and that access to information that they need, it is enough and unnecessary that the information is relevant, it is enough that the information is transcendent, it is enough that the public cares to generate a change in this society,” he expressed.

In his speech at the launch of the policy, the president of the Supreme Court of Justice, Henry Molina, said that the implementation of this document urges judges, prosecutors, defenders, judicial and administrative servants, the legal community, and society as a whole to understand the value of data personal of those who turn to the judicial system and to handle them with the diligence and respect they deserve.
