In the 30 days remaining in the ordinary period in the Senate, there is a tight agenda to clear up, which includes the secondary laws of the ten constitutional reforms that have been approved, fundamentally the modifications to the Magna Carta regarding the Judicial Branch of the Federation (PJF).

In the eighth transitory article of the judicial reform, Congress is given a period of 90 calendar days, from the entry into force of that norm, to adapt the corresponding federal laws, in order to comply with the new provisions regarding the election of judges, magistrates and ministers and in general the new structure of courts, tribunals and the Supreme Court of Justice.

In accordance with this provision, both chambers have a period of three months from September 16, when the judicial reform came into force, to issue secondary laws, that is, until December 16, and therefore in the Senate they are preparing to approve at least two of them.

As a priority, the Organic Law of the PJF which, according to the president of the Senate, Gerardo Fernández Noroña, will be issued during this period of sessions that ends on December 15. That legislation, It had already been worked on and reviewed, but it was preferred to wait in case the Supreme Court invalidated part of the judicial reform, which it did not achieve because the eight necessary votes of ministers could not be gathered..

The modification to the Organic Law of the Judiciary will include the new structure of the Supreme Court, with nine instead of eleven ministers and the disappearance of the Judicial Council, whose place will be occupied by two new bodies, one for administration and the other for fiscal discipline. .

The powers of both bodies should be detailed, especially the Judicial Disciplinary Court, which will be in charge of sanctioning judges, magistrates and ministers who commit irregularities, acts of corruption or fail to comply with the deadlines to resolve the cases referred to them. entrust

The law will provide for the amounts of sanctions in the case of heads of district and circuit courts who, six months after receiving a tax claim, have not issued a ruling. The Constitution provides that from the outset, “the jurisdictional body that hears the matter must immediately notify the Tax Disciplinary Court and the secondary legislation will detail what is appropriate in response to this fact.

On the other hand, the law must specify the cases in which the Senate may grant or deny the resignation requests of members of the PJF, based on the provisions of Article 98 of the Constitution.
