STF has five votes to keep Robinho in prison

The virtual plenary of the Court began yesterday (15) the trial of an appeal by the former athlete’s defense to overturn the decision of the Superior Court of Justice (STJ) that approved the sentence of the Italian Court against Robinho and ordered his immediate arrest, in March this year.

He was sentenced to nine years in prison in Italy for his involvement in the rape of a woman, which took place inside a Milan nightclub in 2013.

So far, in addition to the rapporteur, Luiz Fux, ministers Luís Roberto Barroso, Cármen Lúcia, Edson Fachin and Cristiano Zanin have voted to maintain the prison. Gilmar Mendes was the only one to speak out for his release.

For the rapporteur, there were no irregularities in the STJ’s decision that determined the arrest. “The STJ, in the exercise of its constitutional competence, complied with the Constitution and Brazilian laws, the agreements signed by Brazil in matters of international cooperation and the norms that govern the matter, with special attention to the fact that the patient responded to the process duly assisted by a lawyer he trusts and has been definitively sentenced to 9 years in prison for the crime of rape”, said Fux.

The trial is scheduled to end on the 26th of this month.

Robinho is imprisoned in the Tremembé penitentiary complex, in the interior of São Paulo, known as the “famous penitentiary”.
