Judiciary seeks to protect personal data of those involved in processes

Saint Dominic.-The Judiciary seeks to safeguard the personal information of those involved in a process contained in the decisions issued by the Supreme Court of Justice (SCJ) and the other courts of the country, through the application of data protection policies.

This, after its launch in an event led by the president of the Judiciary, Luis Henry Molina, who expressed that the application of these policies seeks to protect the right to privacy and personal information that is dispensable in jurisdictional decisions, without undermining the right of defense, information and transparency.

It indicates that the implementation of the data protection policy is essential to guarantee that innovation and digitalization do not become threats to the fundamental rights of the people involved in a process, but rather is a tool to reinforce the rule of law.

The data protection policy of the Judiciary establishes the criteria to proceed with the dissociation or anonymization of personal data in the decisions of the Supreme Court of Justice (SCJ) that are going to be published.

As well as documents that are subject to publication or access by third parties or those involved in the process; promoting itself as a guide that can be extended to the jurisdictional acts of the rest of the courts and tribunals in the country, taking into account the need to reduce the use of dispensable personal data in judicial decisions.

While the presiding judge of the Court of Appeal for Children and Adolescents of La Vega, Bernabel Moricete, explained that, with the data protection policy, it is sought that, from the formation of the judicial file, care is taken to that documents released to the public are duly protected.

And that a type of processing of the personal data of the parties to the process is carried out so that they are protected and are not published.

This seeks to create mechanisms against the vulnerability in which people who are obliged to give their information to the courts find themselves and are not subsequently harmed by this process of collecting personal data to protect their rights.

That these documents only be used during the processing of the procedure until a decision is issued and the case being tried is resolved.

As in cases involving minors, the law protects omitting their personal data, the policy protects the information of the mother, father, their address or any element that allows that identification.
The members of the Supreme Court of Justice (SCJ) approved the measure a few months ago.

Then, they gave a deadline for the technical departments to implement it, and with its launch, its immediate application was ordered.

With this plan, the Supreme Court seeks to establish the possibility of applying this policy before issuing the corresponding judicial decision, guaranteeing at all times effective judicial protection for the parties.

Thus, it will be the judicial body that decides what personal data can be excluded from the jurisdictional act.
The application of this policy is addressed to all jurisdictional bodies in the country.
