INE, in the phase of combating challenges

While the Electoral Tribunal of the Judicial Branch of the Federation (TEPJF) remains firm in terms of giving the green light to the election of judges, the National Electoral Institute (INE) is in the challenge phase of around half a thousand requests for protection. against this constitutional and legal reform.

At the INE they are in the middle of the legal process, hence there is still no white smoke to begin preparations for the election of judges, magistrates and ministers, which must take place on the first Sunday of next June.

That is to say, just seven months before those elections, the councilors have not reached an agreement that would allow the organization to start, while their lawyers began to send motions for dismissal through their local offices.

So far there are 525 resources against which the INE has initiated the reply; The highest number of procedures occurred in Guanajuato (48), Veracruz (46), Michoacán (43) and Jalisco. On the contrary, the entities with the least resources are Baja California Sur and Sonora, one in each state; Aguascalientes, three, and Oaxaca and Tlaxcala, with five each. Hidalgo does not report resources.

Additionally, the 11 councilors are jointly preparing a complaint against the court that imposed a fine of 54 thousand pesos on each of them; The brief will be presented in the coming days.

At the same time, an electoral lawsuit will be filed against the effects of the provisional and definitive suspensions.

The INE’s strategy, according to consulted officials, also plans for this week to request the Supreme Court – via the Senate – to order the district judges to resolve the various amparo trials.

In addition, by order of a majority of six councilors, the Executive Secretariat must present, no later than November 19, a constitutional controversy against the legal reform that allows the president of the INE to appoint directors without having the endorsement of the general council and the General Executive Board make decisions including aspects related to the judicial election.

Meanwhile, the upper chamber of the TEPJF determined there is no place to a request from the legal director of the Judicial Council and a civil organization to try to reverse the decision that ratified the power of the INE to organize the election of judges.

The agreement was issued based on the unanimous vote of the five magistrates, but with the reasoned votes of two of them (Rodríguez and Otálora), which ratifies the division of criteria in this upper chamber, the highest instance in electoral matters.

It determines that there is no need to process the document, since it is intended to challenge a plenary agreement issued by this jurisdictional body, whose determinations are final and unassailable.responds to the dissidents, including the National Strategic Litigation Council, who intend to dispute the declaration of the beginning of the process for the election of judges, the preparation of the comprehensive plan and the creation of the Temporary Commission of the INE, created for this process.
