IACHR grants precautionary measures to Czech reservist detained in Venezuela almost two months ago

Jan Darmovzal He is an active reservist of the Army of the Czech Republic and was traveling to Venezuela for tourism, when he was reportedly detained on September 5 in the state of Amazonas. On October 31, the Inter-American Commission on Human Rights (IACHR) adopted Resolution 80/2024, through which it granted precautionary measures for the benefit of Jan Darmovzal, after considering that they are in a serious and urgent situation of risk of irreparable harm to his rights in Venezuela, as he announced this November 1 in a statement.

The beneficiary is an active reservist of the Army of the Czech Republic and was traveling in Venezuela for tourism, when he was reportedly detained on September 5, 2024 by State security agents in the town of Atabapo, state of Amazonas. Since that date his whereabouts would not be known, indicates the IACHR.

“It is alleged that no arrest warrant or investigation was issued against the beneficiary. As well as that he would be held incommunicado and that, despite the fact that the government of the Czech Republic and its consular authorities requested information from Venezuela, It has not been made known in which security agency he is detained, nor has there been any information about his physical or psychological state.”. The organization assures that it did not receive information from the Venezuelan State.

“After analyzing the allegations, the Commission took into account that Since September 5, 2024, the beneficiary has been detained by State agents with an unknown whereabouts. He assessed that, neither at the time of the arrest nor to date, is there any knowledge of the existence of any criminal investigation that would allow verification of the prosecutor’s office involved or the competent court handling the case,” reads part of the document.

The organization says that the public statements of the Executive Branch would indicate that he was detained for allegedly being involved in a plan to attack State authorities. In that sense, they point out that they do not observe elements that indicate whether the State has maintained communication with the country of the Darmovzal nationality.

The IACHR points out that Venezuela has not provided information to the detainee’s family or lawyer and that an attempt was made to present a constitutional appeal for protection, but it was rejected by the competent body.

The commission asked the State to guarantee the right to life and integrity, to inform if he is in State custody and the circumstances of his detention; or, the measures taken in order to determine his whereabouts or destination, as well as informing whether he was presented to court and what crimes he is accused of.

The Commission recalled that it has the mandate to promote the observance and defense of human rights in the region and acts as a consultative body to the Organization of American States on the matter.
