The Constitution and Justice Committee (CCJ) of the Senate approved this Wednesday (30) Bill 5/2022 LINK 1, which prohibits the manufacture, storage, sale and use of fireworks that produce noise above of 70 decibels. The matter was approved definitively and will go directly to a vote in the Chamber of Deputies. 
The opinion of the rapporteur, senator Castellar Neto (PP-MG), proposed changes in relation to the original text, by senator Randolfe Rodrigues (PT-AP). The first version prohibited fireworks that produced explosions of any sound level.
However, Castellar argued that any pyrotechnic device would end up producing noise and thus opted to impose a limit of 70 decibels, which represents the level of decibels supported by people with sensory hypersensitivity.
“It is not possible to simply ban fireworks or any other pyrotechnic device that causes ‘bangs’, as any product of this nature causes, even if minimal, some noise”, argued the rapporteur in his opinion.
In justifying the bill, senator Randolfe Rodrigues argues that noisy fireworks harm the health of children, the elderly and people with disabilities. “It is also worth highlighting the negative impact on people with Autism Spectrum Disorder (ASD), who have sensory hypersensitivity to the noise caused by these artifacts”, he adds.
According to the project, anyone who uses prohibited artifacts will be fined between R$2,500 and R$50,000. For companies that manufacture or sell fireworks, the fine ranges from 5% to 20% of gross revenue, in addition to seizure of the material. Fires intended for export are excluded from the rule.
