8 SCJN ministers resign today; They decline to participate in the election of judges

Today, eight ministers will officially present their resignation to the Supreme Court of Justice of the Nation (SCJN), thereby also declining the automatic pass that would put them on the June 2025 electoral ballot to seek to repeat in office.

The ministers who will present their resignation for consideration by the Senate are the president of the Court and the Council of the Federal Judiciary (CJF), Norma Lucía Piña Hernández, Luis María Aguilar Morales, Javier Laynez Potisek, Juan Luis González Alcántara Carrancá, Alberto Pérez Dayán , Margarita Ríos Farjat, Jorge Mario Pardo Rebolledo and Alfredo Gutiérrez Ortiz Mena.

If accepted by the legislators, his departure would be effective on August 31 of next year and with this the robes will also be able to access their retirement assets, which will be calculated based on the time they were in the Court.

According to court sources, the ministers will not present their resignation jointly, but rather each one will write it in their personal capacity.

The seventh transitory article of the reform of the Judicial Branch of the Federation (PJF) establishes that The ministers of the Supreme Court of Justice of the Nation who conclude their position due to not running or not having been elected in the extraordinary election of 2025, will not be beneficiaries of a retirement benefit, except when they present their resignation from the position before the closing date of the call indicated in section I of article 96 of this decree, which will take effect on August 31, 2025; In these cases, the retirement amount will be proportional to the time of their performance..

Meanwhile, the Senate agreement for the procedure for receiving declines in candidatures from people who are serving as ministers and electoral magistrates establishes that the deadline is October 30, that is, tomorrow.

Minister Luis María Aguilar will have to carry out this process, despite the fact that his 15-year period ends on November 30, since it is the only way for him to access his lifetime salary for his years in the Court.

Jorge Mario Pardo Rebolledo is the second minister with the longest time in the Court, since 2011; They are followed by Gutiérrez Ortiz Mena and Pérez Dayán, whose entry was in 2012; Piña and Laynez, in 2015; González Alcántara, in 2018; and Margarita Ríos Farjat, in 2019.

In the cases of ministers Yasmín Esquivel, Loretta Ortiz and Lenia Batres, the three have already announced that they will use their automatic pass to be on the ballot for the elections of judges, magistrates and ministers for 2025.
