He government Argentina, led by President Javier Milei, has taken a significant step towards the modernization and transparency of the public sector by making official the prohibition of hereditary positions in the public administration.
This measure of Governmentannounced through Decree 959/24 and published in the Official Gazette, seeks to eliminate a practice that has been criticized by many as unfair and contrary to the principles of equality and merit.
The decision to prohibit hereditary positions was promoted by President Milei and the Minister of Deregulation and Transformation of the State, Federico Sturzenegger. In a press conference, presidential spokesperson Manuel Adorni and Sturzenegger explained that the measure’s main objective is to ensure that access to public jobs is based solely on suitability and not on hereditary ties.
“No privileges, advantages or benefits based on hereditary ties will be accepted for access to employment in the National Public Sector, regardless of the type of contract,” the decree states.
The ban on hereditary positions means that relatives and spouses of deceased state employees will no longer be able to fill their jobs as replacements. This practice, which allowed relatives of deceased or retired employees to access their positions, has been seen as an illogical privilege that placed public employees above the rest of Argentina’s workers.
“This illogical privilege placed public employees above the rest of the workers in Argentina. But, from now on, whoever occupies a position in the State will be chosen solely for their suitability,” said Sturzenegger.

The decree also establishes that the Ministry of Labor will not approve collective labor agreements that maintain this benefit. In addition, the provinces, the Autonomous City of Buenos Aires and the municipalities are invited to dictate regulations of the same nature to ensure equal opportunities in access to public jobs throughout the country.
The measure of Government It is part of a broader strategy to rationalize the size of the State, which has already achieved a 15% cut in public personnel and an order for those employees who are of retirement age to retire without delay. “The intention is to deepen the strategy of rationalizing the size of the State, which has already achieved a 15% cut in public personnel and the intimation for those employees who are of retirement age to retire without delay,” explained Sturzenegger.
