A couple of days ago the plenary session of the House of Representatives gave the green light in the second debate to the Government’s labor reform bill. This article came out with several changes, because in the discussion some proposals were eliminated and others were added.

Within these, a new article promoted by the representative of the Historical Pact, María Fernanda Carrascal, was approved, which sought the formalization of passenger and cargo transport workers, so that written employment contracts would be made, with coverage of the Occupational Risk Insurance Company (ARL) by transport companies.
Given this approval, Nidia Hernández, president of Colfecar, within the framework of the international MetCoke summit Colombia 2024, pointed out that this article causes some concern to the union.
“The labor responsibility corresponds to the owner of the vehicle, whether he is a natural or legal person, there it was in that proposal, it is an and/or that is worrying us a lot because the connection contracts would not be taken into account there,” mentioned the union leader.
He assured that a linkage contract is generated when a transportation company has its own fleet of transporters, but the alert is generated when outsourcing that service to meet its cargo mobilization quota.

“Let’s say if you have your own fleet, you will be able to move a lot of cargo in your own vehicles, but it will not be enough to move the entire amount of cargo. Therefore, you will have to subcontract to small vehicle owners, but by subcontracting that service I do not have to take charge of the labor responsibility of the driver who is driving the vehicle, that is a responsibility of the vehicle owner.”he highlighted.
What is missing from the labor reform to be approved?
Given this panorama, the labor reform now goes to the Senate of the Republic, it will begin its discussion in the Seventh Commission and then if it is approved it will go to the plenary session of that corporation.
Subsequently, you must face a reconciliation between what was approved in the House of Representatives versus what is approved in the Senate.
It is worth mentioning that to complete this entire procedure you have until June 20, 2025 to achieve it, in case it does not sink for the second time in the Congress of the Republic.
