How are the new parental licenses that govern in the province of Buenos Aires

New parental leave regime for state governments.

The Government of the province of Buenos Aires made official this Thursday the new parental leave regime for state governments, with the aim of achieving a model that contributes to reducing gender inequalities in the upbringing of children and adolescents.

Decree 140/2022 published in the Official Gazette indicates that, starting this Thursday, all pregnant people will have a new 45-day license to care for the newbornwhich are complementary to the existing 90, so it will be a total of 135 days.

For cases of births of girls or boys with disabilities, they will have 180 calendar days. In addition to the extension in the days of leave, if both parents serve in the province, they may choose who will be the person who enjoys the leave.

At the same time, the leave for the parental co-responsible will be extended from 3 to 15 days. The days of leave for adoption are also extended from 90 to between 120 and 180 days, depending on the age of the child, eliminating the limit of seven years; and the leave for the death of the co-responsible parent is extended, which goes from the current two or three days to a period of one to three months, depending on the age of the minor child.

Finally, the decree establishes that 15 days are added for the care of a sick family member, which thus reaches 35 days.

In this way, the joint agreement that extends the licenses of state workers hired under the regimes established by laws 10,430 and 10,471 became effective.

“This new license regime will imply a change in the work and family life of the entire community, representing an immense advance in the Province that we hope other sectors and branches of activity will accompany”, said the governor of the province of Buenos Aires, Axel Kicillof, on the occasion of the signing of the agreement.

In this regard, the Chief of the Cabinet of Ministers, Martin Insaurralde, stated: “The decision of our Governor Axel Kicillof is very important and cutting-edge, which is committed not only to expanding rights for those who decide to form a family, but also to equate rights and possibilities within the workers of the Buenos Aires public administration”.

For its part, The Labor Minister, Mara Ruiz Malec, highlighted: “It is a historical fact, not only because it is a question of a conquest of rights, but also because this was achieved through social dialogue and consensus with the unions.”
