Dina Boluarte sends PL to Congress so that the President of the Republic leads the 'Council for the Reform of the Justice System'

The President of the Republic, Dina Boluarte Zegarrasent this Thursday, October 24, the bill that modifies the Law on Council for the Reform of the Justice System. This law was created in 2019 during the government of the former president. Martin Vizcarra to promote reform of the justice system.

According to the document to which La República had access, the PL 9297/2024-PE aims to “modify the Law No. 30942; that is, the law that creates the Council for the Reform of the Justice Systemto establish measures aimed at improving the functioning of the aforementioned Council.” The PL of Boluarte Zegarra would modify articles 2, 4, 5, 6 and 7 of said law.

As can be read in the document, the bill proposed by the Executive in article 2 is that “the President of the Republic chairs, in a non-delegable manner, the Council for the Reform of the Justice System”. In the same way, it is added that said Council has “a Technical Secretary who falls, in a non-delegable manner, to the Minister of Justice and Human Rights”which will be in charge of articulating with the technical council for the execution of the agreements adopted by the Council for the Reform of the Justice System.

Likewise, it is proposed that the Council meet in an ordinary manner 3 times a year and once in an extraordinary manner when convened by its president, and no longer once a month and an additional one in an extraordinary manner when the president convenes it. Additionally, the consensuses that are adopted will be published in the digital headquarters of the Ministry of Justice and Human Rights.

It should be noted that, in the current law No. 30942, it is established that the president of the Council is alternated by the members that make it up: The president of the Republic, the president of the Congress of the Republicthe President of the Judiciaryhe Attorney of the Nationthe President of the Constitutional Courtthe President of the National Board of Justicethe Comptroller General of the Republic and the Ombudsman. However, Boluarte proposes that the President of the Republic be the one who directs the Council.

Who is part of the Technical Council?

According to what the law presented by the president proposes Dina Boluartesaid Technical Council for the Reform of the Justice System is confirmed by technical representatives of the State institutions. However, it is striking that, in the bill, the participation of peasant patrols is eliminated to form said council. These would be the members of the technical council:

  • The Congress of the Republic
  • The Judiciary
  • The Ministry of Justice and Human Rights
  • E Public Ministry
  • The Constitutional Court
  • The National Election Jury
  • The National Board of Justice
  • The Comptroller General of the Republic
  • The Ombudsman’s Office
  • The Academy of Judiciary
  • The Ministry of the Interior
  • The Ministry of Economy and Finance

Likewise, part of the functions of this Technical Council will be to be in charge of execute the decisions of the Council for the Reform of the Justice System and propose plans, strategies, projects and actions to improve the Justice System. This Technical Council will meet once a month and, in an extraordinary manner, when required by the main Council, the technical secretariat of the Technical Council or if so required by a third of the legal number of its members.
