Julio Midolo, Bernaola’s lawyer, explained that the magistrate decided to declare the request for dismissal presented justified and excluded his client from the process that was under control of the accusation.
“What you have pointed out [el juez] is that the Prosecutor’s Office did not have sufficient arguments to request a sentence of 11 years and six months against Mr. Bernaola and, as a consequence of this, Mr. Bernaola no longer has to go to an oral trial to resolve whether or not it is responsible,” he said on RPP.
The Public Ministry accused Bernaola of having received transfers from Kuczynski, his employer. However, the accused repeatedly assured that this money was intended for domestic expenses in the former president’s homes. In that sense, Midolo assured that the Prosecutor’s Office used his client “to build that absurd argument of a criminal organization.”
“The damage that has been done to a person who is totally innocent and has been instrumentalized by the Prosecutor’s Office to build that absurd argument of a criminal organization, which would be made up of Mr. Kuczynski, his secretary [Gloria Kisic] and his driver,” he said.
The lawyer did not rule out requesting civil compensation in favor of Bernaola, who, he said, suffered family problems as a result of the process against him.
“I think definitely yes.” [se debe pedir reparación civil]the man has been harmed and there is economic, moral, personal and family damage, which must be compensated by the State in due course,” he indicated.
