The majority of ministers of the First Panel of the Federal Supreme Court (STF) decided, this Friday (18), to reject an appeal by former president Jair Bolsonaro to overturn the decision that denied archiving the investigation into the alleged leak of confidential Police information Federal (PF).STF rejects Bolsonaro's appeal to close an investigation into the PF

The case deals with the live broadcast on social media, carried out in August 2021, in which Bolsonaro released information about the PF investigation investigating the invasion of the Superior Electoral Court (TSE) systems in 2018.

The full text of the inquiry was published on the former president’s social networks. At the time, Bolsonaro stated that the investigation was not confidential.

Bolsonaro’s defense appealed to the Supreme Court to maintain the opinion of former deputy prosecutor Lindôra Araújo, who agreed to close the investigation. Furthermore, the defense wanted to have access to the plea bargain of Bolsonaro’s former aide-de-camp Mauro Cid.

In August 2022, Lindôra told the minister that archiving should be automatic. Despite the understanding, Moraes denied the request and ordered new steps in the case.

The ministers followed the vote given by the rapporteur, minister Alexandre de Moraes, who rejected the appeal for procedural reasons. According to the minister, the process still lacks the sending of the complete case report by the Federal Police.

“From this perspective, the absence of a detailed report on all the material collected hinders the assessment of issues relating to substantive law. In view of the above, I deny the procedural appeal”, decided the minister.

The understanding was followed by ministers Flávio Dino, Cristiano Zanin and Luiz Fux. For the virtual trial to be closed, Minister Cármen Lúcia’s vote is missing.
