Drabesset Natividad Sarrín Maguiña

The Public Ministry concluded the appointment of prosecutor Marita Sonia Barreto Rivera as coordinator of the Special Team of Prosecutors against corruption in power and entrusted the office to the lawyer Drabesset Natividad Sarrín Maguiñain the middle of an open disciplinary process against him.

The disciplinary process against Barreto focuses on alleged very serious offenses committed by the aforementioned prosecutor in the exercise of her duties.

He is accused of omissions in the management of cases of high national relevance.

In that sense, according to the provision published in El Peruano, the Prosecutor’s Office highlighted the need to maintain continuity in investigations into corruption of senior officials and, therefore, appointed Sarrín Maguiña as the new coordinator of the team.

In article 3 of the resolution it is indicated: “Inform the lawyer Marita Sonia Barreto Rivera that she must carry out the corresponding delivery of office, in accordance with the provisions indicated in the General Directive no 007-2002-MP-FN “Norms for the Delivery of Charge”, approved by Resolution of the Prosecutor’s Office of the Nation no 972-2002-MP-FN, dated June 13, 2002, as well as the provisions of the second paragraph of article 76 of the Regulations of the disciplinary procedure of the National Control Authority of the Public Ministry”.

PRONUNCIATION OF THE PROSECUTORS

After having become aware of Resolution No. 89-2024-ANC that suspends Dr. MARITA SONIA BARRETO RIVERA in the position of Senior Prosecutor and Coordinator of the Special Team of Prosecutors Against Corruption of Power (EFICCOP), in the regular exercise of our right to freedom of expression, we issue the following statement:

FIRST: WE SUPPORT AND RATIFY the hard work that Dr. Marita Sonia Barreto Rivera has been doingin her capacity as Senior Prosecutor and Coordinator of the Special Team of Prosecutors Against Corruption of Power, since its creation, who with intelligence, honesty and courage has led this group of prosecutors committed to promoting the complex investigations carried out against alleged members of criminal organizations linked to political, economic and/or factual powers, contributing with efficient and effective legal-legal strategies, respecting the principle of autonomy of each of the EFICCOP prosecutors, who have made decisions motivated solely within the framework of the Constitution and the Law.

SECOND: WE CONSIDER THE DECISION OF THE NATIONAL CONTROL AUTHORITY OF THE PUBLIC MINISTRY TO BE DISPROPORTIONATEthrough which it was resolved to suspend the position of Senior Prosecutor and Coordinator of the Special Team of Prosecutors Against Corruption of Power, as it is a precautionary measure that is not based on any real, objective and/or concrete danger of obstruction in the disciplinary investigation work, since it is based on information disseminated by some media, which, in our opinion, constitutes uncorroborated and biased information and, in turn, would be aimed at destabilizing the EFICCOP.

THIRD: WE WARN that the decision adopted by the National Control Authority of the Public Ministry WEAKENS the strategic unity of EFICCOP to successfully face the various investigations in our charge, such as: “Anguía Case”, “Reconstruction Operators”, “The Waykis in the Shadow”, “Markagroup”, “The Untouchables of Corruption”, “The Prosecutor and its leadership”, “Shadow Advisors”, “Shadow Criminal Intelligence”, “Minsa” among other highly complex investigations.

FOURTH: Despite the disproportionate suspension of our senior coordinating prosecutor, the Prosecutors who are members of EFICCOP REAFFIRM our commitment to continue with the frontal fight against corruption, wherever it comes from and whoever falls; and WE ANNOUNCE that we will redouble our efforts to fulfill our functions within the framework of the Constitution and the Law.
